Room Booking Conditions

The following Booking Conditions together with all other details contained in the Vaha brochure and supplementary information held on our web site form the basis of your contract with Vaha Spa and Health Club Limited ("Vaha"). Please read the following information carefully, as it sets out our respective rights and obligations.

In these Booking Conditions, "you" means all persons named on the booking (including anyone who is added or substituted at a later date). "We" "us" and "our" means Vaha Spa and Health Club Limited.

Vaha's Commitment to You

1.Your Reservation

All accommodation and facilities advertised in the Vaha brochure and on our web site are subject to availability. When you, or your travel agent ask for your accommodation booking to be confirmed, if available, we will allocate your chosen accommodation booking to you at that moment. If you choose to book your accommodation directly with us we will confirm the booking and give you a reference number. You will then have to pay a minimum deposit of 10% of the full booking value to secure the booking. When we have received the deposit monies due we will issue a confirmation invoice setting out exactly what has been booked and the amount of deposit money paid. The remaining balance of payment due will be charged to you upon check-out at the close of your stay.

You are advised to independently, or through your travel agent, obtain appropriate holiday insurance to cover the planned endurance of your stay.

2.Price Promise

Whatever happens to the value of the Pound (British Pounds Sterling), the price of your accommodation - once confirmed at the time of booking - will not be subject to any currency surcharges.

However, we do reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of any such error. Should there be an obviously incorrect price shown we will issue a new invoice and we will not be bound by the price quoted on any incorrect invoice previously issued.

3.Our Invoice

Please check your confirmation invoice carefully and notify us immediately of any inaccuracies so we may correct and reissue your invoice. We will send your invoice by the quickest available means of communication with you and your travel agent, be that e-mail, fax, or mail delivery.

4.If We Change or Cancel Your Booking

Force Majeure: We may, in exceptional circumstances, be forced by "force majeure" to change or terminate your booking. This is extremely unlikely, but if a situation does occur we regret we cannot accept liability or pay compensation where the performance or prompt performance of our contractual obligations is prevented or affected by "force majeure". "Force majeure" means any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil disobedience, terrorist activity, industrial disputes, natural or nuclear disaster, epidemics, health risks, fire, technical problems to transport, closure or congestion schedules by scheduled airlines and all similar events outside of our control.

5.Resolving a Complaint

We know that in spite of all our best efforts, problems can arise. If you experience a problem with the booking procedure, or a problem arises during your stay with us please notify us immediately and allow us to investigate and rectify your concerns at the earliest opportunity. We will endeavour to ensure a prompt and amicable settlement is reached where ever possible.

6.Our Responsibility

We will accept responsibility for all common parts of your stay with us are supplied to you as described in the Vaha brochure and web site to the high standards we set. Common parts of your stay with us include your cottage and use of our facilities, but will exclude any activities booked through us at your request with independent suppliers such as car hire or local horse riding stables etc.).

We also accept responsibility for what our employees, suppliers and sub-contractors do or do not do providing they were at the time carrying out work directly authorised by us. If any part of your stay is not provided as advertised and to a reasonable standard, we will seek to remedy the situation provided you have taken all reasonable steps to notify our staff and given us the opportunity to seek remedy.

We can not accept responsibility for death, injury or illness arising during you stay with us unless it is proved this was caused due to the negligence or omission of our employees, suppliers or sub-contractors whilst carrying out their duties on our behalf.

If during your stay with us you or a member of your party suffers illness, injury or death through misadventure whilst participating in an activity outside of our control, we will of course provide you with all the reasonable assistance we can.

If, in our opinion, or in the opinion of any other person in authority, you or any member of your party behaves in a manner to cause or likely to cause danger, annoyance or distress to a third party or damage to property, we will either ask the person(s) concerned or guardian(s) of any minor(s) concerned to ensure restraint from such behaviour and/or we may terminate the stay with of us of all the person(s) concerned. In these circumstances the person(s) concerned will be required to pay any outstanding balance with us and to leave the Vaha Spa and Health Club Limited site. We will have no further responsibility towards such person(s). We will not pay any refunds or pay any expenses incurred as a result of termination in these circumstances.

Your Commitment to Us

1.Booking and Payment

Age: Bookings for younger people will not be accepted unless one member of the party is 18 years of age, or older and is the lead name for the booking.

Vaha has been purposely designed for couples. Please note, in order to retain a tranquil atmosphere for our guests, particularly in the swimming pool area but also surrounding the guest cottages, only young adults 16 years of age or more may be permitted to use the facilities in the Spa.

We regret that we can not accept accommodation bookings which encompass accommodating infants, or children.

Deposit: At the time of the booking you pay an initial 10% of the total booking value. Once this is received by us this constitutes acceptance of our Booking Conditions and a commitment to proceed with the booking. When we receive the deposit monies due we will issue a confirmation invoice setting out exactly what has been booked and the amount of deposit money paid.

Paying the Balance: The remaining balance of payment due will be charged to you upon check-out at the close of your booked accommodation period. This will include any items expensed to your guest cottage(s) during your stay.

2.If You Change Your Booking

Amendments to Your Booking: If you wish to change your booking after we have issued our invoice, we will try our best to help but may not be able to provide your requested change and we will have no obligation in this respect.

If you are prevented from travelling due to circumstances outside your control such as a death, accident, illness, witness summons or redundancy of yourself, travelling companion or close relative etc., you may transfer your booking to another person or group provided you give us at least 21 days' notice and the arrangements remain exactly the same as the original booking.

3.If You Cancel Your Booking

Should you, or a member of your party, be forced to cancel, you must advise us at the earliest opportunity.

Any deposit paid will be non-refundable.

If the reason for cancellation falls within the terms of your holiday insurance policy, you should make a claim direct to the insurance company for the recovery of charges.

4.During Your Stay

The accommodation provided is only for the use of persons shown on your invoice as confirmed by us. Sub-letting, sharing or assignment is prohibited. You are responsible for any damages caused to the property during your stay, except by persons not known to you or us and unconnected with the contract between us. If you are responsible for any damage all costs in this respect must be met by you and paid locally.

Occasionally, it may be necessary for us, or other persons authorised by us to carry out specific task(s), to enter the property during your stay for the purposes of quality control, maintenance or emergency repairs etc. Wherever possible you will be notified of this beforehand.

No smoking is permitted within any building on our site including inside guest cottage accommodation. Smoking is also prohibited in the general grounds of our site due to the ever present risk of poorly discarded cigarettes/cigars etc starting brush fires, which can quickly take hold and spread uncontrollably in dry summer conditions.

The exception is the restaurant where smoking is permitted provided it does not interfere with the enjoyment of fellow patrons and ash trays are used by smokers to dispose of their cigarettes/cigars etc.

Guests are also permitted to smoke on the terrace areas of their guest cottages, but are requested to please be sure to extinguish and discard cigarettes/cigars responsibly in their cottage's ash trays and help us reduce the risk of brush fires.

Please note, that we may remove anyone whose behaviour is disruptive or affects the enjoyment of other guests (see Clause 6, "Our Responsibility" of the Booking Conditions)

5.Conditions and Prices

Any published Vaha brochure may be superseded by future editions, our web site and by any details advised to you in writing or on a confirmation notice.

The prices quoted in a published Vaha brochure are based on exchange rates applicable at the time of publication. Any services purchased from us will be based on British Pounds Sterling, with courtesy conversion of prices in YTL (Yeni Türk Liras? - New Turkish Lira) based upon a general exchange rate.

If you wish to settle any payment in YTL, then a current exchange rate (taken from Turk Bank's published exchange rate for the given day) will be applied and used for the transaction.

6.Data Protection

In order to process your booking we will need to use information you provide such as name, address, any special needs, disabilities or dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to credit card companies, or authorities as required by law. In making a booking with us, you consent to this information being passed on to relevant agencies/persons.
